Ms. Weyker’s injuries were too severe for officers to issue a field sobriety test and even get a breath sample. However, Weyker was arrested anyway on five charges including, “drunk driving causing injury.” Tests would later prove Weyker’s innocence finding no trace of alcohol or drugs in her system.

So why was she arrested? Todd Korb, Weyker’s lawyer, told WITI that the arrest was surprising because the authorities had virtually no evidence she was drunk. Korb said, “I can’t say it is necessarily a cover up, but it is suspicious.” Andrew Mishlove, a drunk driving defense expert, told the station that the only cause to arrest Weyker would have been if Deputy Quiles pointed the finger at her. “I think he was trying to protect himself and his department, to be honest,” said Weyker.

In Deputy Quiles’ original report, he claimed that he came to a full stop at the stop sign and never saw Weyker’s headlights (Weyker’s car’s headlights were automatic). However, airport surveillance footage surfaced two days after the crash and refuted Quiles’ first account, showing him rolling through the stop sign. Even though this evidence showed Quiles was at fault, Weyker was still sent threatening letters by the county saying legal action would be taken if she didn’t pay for the damages.

Ten months after the accident, after a Sheriff’s Office internal investigation, Quiles admitted that his first statements were wrong and that he was at fault for the accident. Quiles was suspended for nine days for the accident, but never punished for his false report, despite, WITI notes, “a previous history of discipline for filing reports written by someone else.”

Even though Quiles has admitted fault and the district attorney has decided to not file charges against Weyker, she is still waiting for the county to pay her mounting medical bills, which her attorney says could top one million dollars. Ms. Weyker has filed a complaint against the arresting deputy and may file a civil rights lawsuit against the county.

I wonder if an armed neighbor could have opened fire on the cops and justified it on the basis of the stand your ground laws.

Toddler severely burned by stun grenade during police raid on Georgia home

A 19-month-old boy was sleeping in a Georgia home with his parents and three older sisters when police entered, looking for a drug suspect. Officers threw a stun grenade into the boy's crib, critically injuring the toddler, his parents say. The family, visiting from Wisconsin, was not associated with the crime, and the suspect was arrested at a different house.

A 19-month-old boy is fighting for his life after a SWAT team threw a stun grenade into his crib during an overnight home raid, the toddler's family says.

Police were looking for Wanis Thometheva, who sold methamphetamine to an undercover officer Tuesday evening, police said.

But when the team raided his Georgia home, the Phonesavanh family was inside — not Thometheva.

The Phonesavanhs, visiting Habersham County after a fire at their Wisconsin home, were sleeping when officers entered around 3 a.m. Wednesday, the Atlanta Journal-Constitution reported.

Police tossed a distraction grenade through the door. It landed on 19-month-old Bounkham "Bou Bou" Phonesavanh's pillow.

Bou Bou suffered serious burns and is now in a medically induced coma.

His parents said he has a 50 percent chance of surviving.

"It blew open his face and his chest," the boy's mother, Alecia Phonesavanh, told the newspaper. "Everybody was asleep. It's not like anyone was trying to fight."

The boy's parents and his three older sisters — ages 3, 5 and 7 — were all uninjured.

Police arrested the suspect at another home on felony drug charges. Bounkham "Bou" Phonesavanh, the toddler's father, said the family has nothing to do with the crime.

Any relationship between The Phonesavanhs and Thometheva was not clear.

The sheriff's department called the incident a "terrible accident" but said the unit followed raid protocol.

The stun grenade is a standard device used to distract suspects so officers can enter homes safely, Habersham County Sheriff Joey Terrell told the newspaper.

"There was no clothes, no toys, nothing to indicate that there was children present in the home. If there had been then we'd have done something different," Cornelia Police Chief Rick Darby told WSB-TV.

Darby said all officers are upset about the incident.

"You're trying to minimize anything that could go wrong and in this case the greatest thing went wrong," he told the TV station.

The Phonesavanhs are angry and heartbroken.

"It's my baby. He's only a baby. He didn't deserve any of this," Alecia Phonesavanh told WSB-TV. "He's only 19 months old. He didn't do anything."

The family doesn't have insurance. A family friend has set up a fund to help pay for Bou Bou's medical treatment.
