He would definitely do it to be petty. I don't believe having SCOTUS on conservative lockdown for a generation really matters to him though if he loses. Unless he thinks it helps his kids in 2024/28

They might have to replace two Supreme Court justices, because I think John Roberts might honestly be tempted to throw himself out a window.

In terms of timing, there's is no possible way this could have been worse, and I do mean for the entire country, rather than a particular side. No matter what, whether they fill the seat and Trump wins, or they fill the seat and a Pres. Biden packs the court (which I'd imagine he would have to), it's just another huge step into the Court being wholly viewed as illegitimate.

Although, I actually thinks it's more possible than most seem to that there will be four GOPers who would sign on not to vote.

Well they can’t nominate a Supreme Court justice because McConnell said you can’t last time when this happened during the Obama admin’s last year. So he can’t go back on that unwritten rule. Right?

Honestly the worst move Trump could make would be to fill the seat before November. Doing so motivates the Democratic base even further to get out the vote, decreases the need for conservatives to hang onto him (what with having gotten their conservative court and all), and will absolutely blow up moderate Dem support for expanding the court.

Waiting until after the election is his safest option. So I assume he’ll nominate someone tomorrow.
