I don't know if this has done much to take attention from the travel ban.

I was digging through articles last night, trying to figure out "how bad is this." And then I was like, "well, the guy is just like Scalia. Nothing I read will change this. The court will be made up of the same people it was made up of a year ago. Fuck it! Back to the Travel Ban!"

"I hope Senators will give Gorsuch fair consideration and respect the result of the recent election with an up-or-down vote on his nomination, just like the Senate treated the four first-term nominees of Presidents Clinton and Obama.” - Mitch McConnell, February 1, 2017

I know we're probably not going to agree on this, but this is just obvious politics to me. The Democrats may very well reverse roles as well by becoming obstructionist even though they have a much weaker hand than the GOP did last year.

The thing here that blows my mind is the audacity of McConnell's statement. I get the games that are being played, and although I wish politics were more about running a country and less about "playing a game." His statement, pretending that he's been so respectful and fair to Democrats and that they owe him a favor for that, makes me want to vomit on his head.

Kennedy, Ginsburg & Breyer already have 4 clerks each lined up for 2017. Clearly, your Zodiac Killer hypothesis makes the most sense here.

About as optimistic of a take on Gorsuch as you're going to get, from Radley Balko.

Just FYI... Balko's super libertarian. Or was.

Oh I'm well aware. Lately, thought, he's been overwhelmingly focused on the civil liberties portion of the libertarian platform, earning him some cred and respect among the left.

Hey, didn't British parliament do the West Wing "pretending like all the legislators had left the building and then storming in during the vote" trick?

Thomas just issued an opinion in which he expresses criticism as to how much leeway civil asset forfeiture has gone (Leonard v. Texas):

https://www.supremecourt.gov/orders/cou ... r_6j37.pdf

This seems like an issue in which the edges of both the right and left wings of the Court could unite.

Single Justices can issue opinions?

They're not binding opinions of the Court, but yes, they can issue individual opinions on whatever case comes their way if they want. Thomas had two of them today, and Sotomayor also had one.

I mean really anyone can issue an opinion about anything if you think about it
