Had $2700 worth of kitchen equipment arrive damaged. The distributor said I'd get my money back after they completed their internal review of the shipping process to see who was at fault. They said it would take up to 120 days, and "in most cases" there aren't any problems with a full refund. So I started digging deeper -- turns out that if there's an internal dispute about who's at fault, I may not receive a full refund. What they were conveniently glossing over was the fact that this equipment was:

1. Purchased from the distributor in question
2. Shipped from the equipment producer's facility, because the distributor didn't have one in stock
3. Shipped via UPS Freight, who
4. Sub-contracted the freight to another company from FL to Belgrade, MT, who themselves
5. Sub-sub-contracted the last 100 miles to a third freight party.

After three hours of customer service BS, I said, "You want to tie up $2700 of my working capital in your internal review bullshit. There are two scenarios here: You either send me new equipment tomorrow at no extra cost, or I'll take you to small claims court." She put me on hold for five minutes, came back and said, "Ok, the equipment's going out tomorrow."

:-| This is disheartening, because this is the first year we got an accountant to do our taxes (personal, and for my new business), and we were concerned that she doesn't know what she's doing, but aren't really sure how to find out. I think I'll find another one based on positive recommendation next year.

just keep everything..we got audited when living in ny due to the property we bought in miami all because he checked the wrong box on a return..it was fucking painful but luckily the firm paid for everything and we never had to talk to the irs....since you're starting a business, keep everything..receipts, emails, etc...

Purchased a commercial fridge in May. The unit arrived DOA. The manufacturer has failed to honor the warranty because the only repairman is 100 miles away, and they don't want to pay him for the drive. This has been a constant headache for me the last three months. Finally threatened the distributor with a small claims court filing, got everything organized in case they thought I was bluffing...

Today they refunded me in full for the fridge, and said I could keep the unit! If I can track down the part, I'll have a brand new, NSF fridge valued at $1500 for about $100 (plus another $150 in lost product).
